Hello,

Is there any way to use a digital signature with an RSForm? I need to create a form as a contract that users will be legally bound to because of their digital signature.

Any thoughts anyone?

Hi,

I was/am in the same situation. I currently have my clients fax me the signed agreements, but there are many problems with as you may already know. I asked an attorney (a free one from a local university) and was told the following...

"To be legally binding, a digital signature must show the following:

a) That the person signing is who they say they are (i.e. If I say I am John then there must be a way to prove that I am indeed John).

b) That the intent to sign by the signer (the person signing) can be shown (i.e. possibly by having them create an account and click a link in a confirmation email while also tracking their IP address)."

Supposedly, emails are as personal as credit card numbers, social security numbers, etc in the sense that no one else than the owner should have access to them. The IP address of the computer can trace the physical location of the user and can also assist in identity verification.

Now, I don't know if you have to store the signed files in any specific format or way, but I don't think so. If you get any different info, please keep me up to date because like I mentioned at the beginning...I am also trying to switch to digital signatures.
